STANDARD TERMS AND
CONDITIONS OF CONTRACT

Sure Voyager Travel (Pty)
Ltd, its branches, subsidiaries and associated companies, (hereafter known as Sure
Voyager Travel or the Company) is a travel agency registered by the Travel Agents
Board as a Retail Travel Agency and is a member of the Retail Section of the Association
of Southern African Agents (ASATA).
Code of Conduct
These conditions are laid down in accordance with the ASATA Code of Conduct,
which Sure Voyager Travel undertakes to uphold in every respect.
These Conditions
The conditions laid out below apply especially when Sure Voyager Travel acts as
an Agent or sub-agent, in other words, when the Company provides a client with travel
or other services on behalf of Principals or other Agents engaged in or associated
with the travel business, inter alia, airlines, shipping companies, car hire and
touring firms, tour operators, hotels and other providers of air, land and sea or
any other travel arrangements or products or services.
Bookings
The term “the booking” or “the reservation” refers to part or all of the specific
travel arrangements for transportation, accommodation, sightseeing and other linked
travel services made on behalf of the client with Principals and parties for whom
the Company acts as agents and exclude services of a peripheral nature as defined
in the “Responsibility” clause. Any such booking made by the Company constitutes
a form of contract between the client and the parties referred to above and is consequently
subject to the terms of the Company’s and those parties Conditions of Contract.
Wherever possible Sure Voyager Travel will endeavour to confirm the status of the
booking in writing but may not be able to do so in every case due to time and other
constraints, and failure to provide written confirmation shall not be considered
by the Company to negate the validity and conditions of the bookings or to constitute
an act of negligence on behalf of the Company.
Deposits
Unless full payment is due at the time of making the booking, all bookings
must be accompanied by the deposit or guarantee of deposit requested by Sure Voyager
Travel, part or all of which shall be non-refundable. The deposit constitutes part
of the booking conditions and Sure Voyager Travel reserves the right to cancel any
booking without prejudice in the event of a deposit or guarantee of deposit not
being received.
Final Payment
Final payment is due at least six weeks prior to departure unless specified arrangements
have been made between the Company and the client. Final payment is based on the
quoted and confirmed price, less the deposit paid, plus any specified additional
charges that may have been incurred.
Additional Charges
Aside from passport, visa and other peripheral service fees charged to the client,
Sure Voyager Travel reserves the right to make late booking charges, communications,
consultation, administration and amendment fees where applicable.
Cancellation Fees
The Company will undertake its best endeavours to provide the services required
by the client, but in the event of cancellation of part of or all of the booking
by the client, the Company reserves the right to make service, administration, communication
and cancellation charges. Furthermore, it is a condition of business that such charges
made by the Company are over and above any cancellation charges made by Principals
and other parties with whom the booking is held.
Responsibility
The Company will provide, on request, the identity, terms and conditions of our
Principals and other parties for whom we act directly as agent, relevant to the
services provided in the booking. However, should any act or omission by a Principal
or other party on behalf of whom we act as agent adversely affect the travel arrangements
made on behalf of the client, Sure Voyager Travel will not accept liability
for any claim arising from such an act or omission unless the Company has acted
negligently. Furthermore, those parties for whom we act as agent may
also disclaim responsibility in that they act as agents themselves or have contracted
out of liability, as may the ultimate Principals such as hotels, car hire and coach
operators, and we recommend that appropriate insurance be taken
out by all clients to safeguard themselves in situations where they have no doubtful
recourse.
Peripherals Requirements
Sure Voyager Travel will do its utmost to assist clients in obtaining or
meeting their requirements for passports, visas, health documents, insurance, foreign
exchange, Reserve and other Bank approvals, use of credit cards, customs and immigration
regulations and other peripheral requirements or services falling outside the actual
travel arrangements made with Principals and other parties for whom we act as agents,
and referred to as “the booking” or “the reservation” but, due to the constantly
changing nature of these peripheral requirements and services, the Company cannot
be held liable for ensuring that these requirements and services are provided correctly
or timeously or at all, or for the accuracy of any information or for any lack of
information relating to such requirements and services.
